Nairobi - The Supreme Court has re-instated Nathiff Juma as Garissa Governor to office, saying that there were not too many irregularities to change the election result.
Chief Justice Willy Mutunga agreed with an earlier ruling that even though there were irregularities, there was no proof that it would cause the result of the election to come into doubt.
" It has been unanimously agreed that the case put forward is not enough to sway the final decision and change the fact that the people of Garissa made a choice, he said in the ruling.
The decision will end a protracted battle for the seat which started in August 2013.
Abdikahim Osman who is the petitioner had moved to the High Court which had earlier ruled that there was not enough evidence to overturn the election.
He had then gone on to the Court of Appeal which had overturned the ruling due to what it termed as negligence of crucial aspects of the case by the High Court.
Osman has been ordered to cover the petition costs incurred by all parties by the Supreme Court.
