Mombasa High Court okays ODM elections

The High Court in Mombasa yesterday gave ODM the green light to commence its grassroots elections. Justice Edward Muriithi refused to grant an application that had been filed by aspiring governor and banker, Suleiman Said Shahbal, to stop the elections.

Muriithi said the polls could go ahead owing to limited time and that later, the parties could argue on the constitutionally of the elections. He said since the defendants, ODM secretary general Anyang Nyong’o, chairman of the ODM national elections board Philip Okundi, ODM election Coast regional commissioner Charles Werangai and the Registrar of Political parties had not been given enough time to file a response, they should be accorded the opportunity.

Delivering his ruling the judge said, “We cannot condemn the other side unheard and that is why the court cannot issue any orders at this stage.”
