Nyeri couple in court of matrimonial home

02 September 2016, 19:27

Nyeri – A couple are in court over a house dispute where an estranged husband is being sued for Sh8 million.

According to the Daily Nation Juliet Wangui claims she purchased their matrimonial home and is before the Nyeri High Court to get an eviction against, Francis Ndegwa.

The couple were in court previously over their late son’s property in Buruburu estate, money in the bank and several commercial vehicles.

Juliet Wangui claims she took a loan out to buy the house and has taken 18 years to replay the loan.

The matter is to be heard on September 21.

Another couple in Nyeri are being heard before the Supreme Court over ownership of their matrimonial home The Standard Media reports that PW and JK have concluded their 25 year marriage after JK is accused of having strayed from the marriage with another woman.

The couple are disputing 18 properties which were purchased during their marriage. However the matter under dispute is how the properties will be split.

JK after the end of their marriage transferred the matrimonial property to his siblings and his lawyer and his friends to defeat my interests of having the same shared equally.

However Justice Sergon ruled against the wife explaining that property that had been transferred to third parties could not be treated as matrimonial property.

He also ruled that PW had not proved her financial contribution towards the identified matrimonial property.

The matter was then taken to the Court of Appeal where judges ruled in PW’s favour.

The matter is currently before the Supreme Court where a further appeal has been lodged.
