AG Githu Muigai blocks the recruitment of new CJ

11 August 2016, 15:02

Nairobi - The ongoing recruitment of a new Chief Justice is facing new hurdles after the AG, Githu moved to court to challenge the process.

Muigai wants the court to reinstate the President’s powers to pick a CJ of his own choice, Standard reports.

In May, a five-judge bench declared an amendment to the JSC Act which gave the President powers to appoint the Chief Justice and Deputy CJ unconstitutional.

JSC is thus supposed to shortlist three candidates for the CJ and Deputy CJ positions and submit them to the President for appointment.

The recruitment of the new CJ and Deputy CJ has been marred with a myriad of challenges.

In July, Standard reported that three different parties filed cases questioning the credibility of the criteria used by the JSC to short list candidates for the positions.
