Appeals court grants Barasa ICC reprieve

Nairobi - The court of appeal has temporarily granted journalist Walter Barasa leave from extradition to the Hague based International Criminal Court ICC.
A three judge bench ruled Thursday that Barasa be allowed to have a case in which he is appealing an earlier High Court ruling ordering his extradition be heard first.
His lawyer Kibe Muigai had asked that the order to have him arrested be rescinded because Barasa had not been handed a fair hearing by the High Court.
He is accused by the ICC of purporting to and bribing witnesses in the crimes against humanity case facing deputy president William Ruto.
He has however argued that there is no constitutional basis for the ICC to extradite him.
The High Court had ruled earlier this month that Barasa be extradited, with Justice Richard Mwongo giving the go ahead to have him arrested by the police.
