Principal magistrate Joyce
Gandini Wednesday barred the prosecution from using a proxy witness to
present video clip evidence in the case in which Waititu is accused of incitement to violence two years ago.
She insisted that the prosecution must use the required evidencial procedures to press through with the case.
Waititu was caught on camera making the inciting remarks but the magistrate insists that a person who was at the scene and took the clip using his or her phone must testify personally.
"Without the said persona in court it renders the evidence incomplete," she stated.
The case will continue 12 July 2016.
