Man sent to gallows for rape, robbery

Nyeri - A young man has been sentenced to death by a Nanyuki court for being involved in robbery with violence and raping a woman.
Augustine Ndereba was convicted by Senior Resident Magistrate Evanson Bett for robbing Naftary Muiruri his motor bike and a phone all valued at KES. 89, 500 at gun point on April 28, 2014 at Narumoru area, Nyeri County.
The accused was facing other three counts of being found with a fire arm, seven rounds of ammunitions and rape.
It is alleged at around 6.30 pm the accused raped a woman who was heading home from work at a gun point.
After the ordeal the woman reported the matter at Narumoru police station before proceeding to a nearby health centre for treatment.
While a search for the accused was going on, four days later, the accused robbed Njau his motorbike after pretending to be a customer.
Njau had told the court how he was approached by the accused to take him to Narumoro Town, while on the way the accused robbed him at gun point before he reported the matter to police.
The accused was arrested at his home on May 12, 2014 where the said pistol and ammunition were recovered.
Later, the complainants were called and through an identification parade they were able to positively identify the accused before he was charged and arraigned in court.
The accused denied the allegations and in his defense he claimed to have been arrested by police officers while heading to a slaughter house.
However, the court found that the prosecution had proved its case beyond reasonable doubt and found him guilty of the crimes.
The court sentenced him seven years for being found with fire arm and ammunition, 10 years for rape and death sentence for robbery which will run concurrently.
