Man, 60, guilty of defiling his 10 year daughter

Narok - A 60 year old man has been sentenced to serve life imprisonment after a Narok Court found him guilty of defiling his 10 year-old daughter and deliberately infecting her with HIV/AIDs.
Benedictus Ajambo Anzaya, a resident of Majengo area in Narok North Sub-County, was found guilty after four witnesses who included the minor, clinical officer who treated the girl, HIV/Aids coordinator and Children officer gave their testimonies in court.

He was accused of defiling the minor on diverse dates between October 2014 and February 2015.
According to the medical reports, both the girl and the mother were HIV negative at the time of her birth.
The reports also shows that the girl had been defiled severally as her hymen was broken and had started developing blisters in her private part.
The court heard that the accused threatened the girl not to tell anyone.
According to the reports in court, the girl has been living with his father and younger brother after the death of her mother five years ago.
The girl decided to report the matter to her teacher after who in turn reported the matter to the children office.
The Prosecution led by Simon Ihaji told the court that the accused was a first offender but prayed the court to take a stern punishment since the he had been committing the crime on a period of time.
“The accused is a dangerous offender and should be supervised in prison so as not to infect another person with the dangerous disease,” he said.
In his mitigation, the accused caused laughter in court after he vocally narrated how he is innocent and has been preaching the word.
“The holy book doesn’t allow me to sleep with my daughter and people know me as a bishop, how can I commit such a crime,” said Anzaya.
Narok Senior Resident Magistrate Allan Sitati sentenced him to life imprisonment in each of the two counts: that is committing incest and deliberately infecting the girl with HIV/Aids. He will however serve the two sentences concurrently.
The magistrate however asked the culprit to appeal before 14 days are over if he was not contented with the judgment.
The court further ordered the children office to take care of the ailing girl by securing her a safe environment to live in and providing all her basic requirements until she attains the age of 18 years.
