Head teacher to appear in court for sacking an ECD teacher

Nairobi - A primary school head teacher and her board of management in Laikipia County is set to appear before the Employment and Labour Relations court in Nyeri tomorrow morning for sacking an ECD teacher.
Ms Mary Munene and the board of management (BOM) of Nyahururu’s DEB primary school have been sued by the Kenya Union of Pre Primary Education Teachers (KUPPET) for sacking Salome Maina, an ECD teacher at the school for actively participating in union matters.
The order to appear in court was served on the head teacher today morning by Nyahururu advocate, Mr John Kaburu.
The secretary general of the Union Mr Samuel Opiyo wants the court to order Ms Maina’s immediate reinstatement pending hearing of the case.
The union argues that the BOM acted outside its mandate since it does not qualify to govern ECD and also it is not the employer of ECD teachers.
The union also wants the respondents to pay the cost of the case. The head teacher, being the secretary to the BOM handed Ms Maina a letter expressly terminating her services as an ECD teacher.
The union argues that termination of the teacher’s employment was a violation of the Employment Act since she was not heard at all.
The BOM accused the teacher of holding anti-establishment meetings among other things. Ends
