Nyahururu resident magistrate, Willy Cheruiyot, ordered the case to be mentioned next week to allow prosecution to avail a medical report on the mental status of the complainant, that will be furnished to the defense, ahead of the hearing.
The three were accused of raping a 21 year old mentally retarded woman and leaving her for death on March 8, last year in Jua Kali area, Ol Kalau town in Nyandarua County.
The third accused, a school girl is said to have been used by the two brothers to lure the complainant to a hideout where they raped her.
The case had attracted a public outcry after the victim, who was left unconscious after the ordeal, was put under intensive care at J M Kariuki Memorial hospital for several weeks. The victim has since been discharged but is said to have developed hysteria.
The three accused were released on Shs.200, 000 bond each in May last year, sending fears that they might compromise the case as they came from an influential family in the area.
Another fourth accused person, said to have conspired with the two brothers is remanded at Nyahururu GK remand prison.
