Victory for Ruto as ICC throws out recanted evidence
12 February 2016, 19:18
Nairobi - Deputy President William Ruto has won big as the ICC appeals chamber rejects use of recanted evidence in the case against DP Ruto and Joshua arap Sang.
The appeals chamber made the ruling Friday, a huge blow to the Prosecution and chief Prosecutor Fatou Bensouda.
Ruto wanted article 68 which allowed the use of recanted evidence withdrawn.
The prosecution had won the right to use evidence that had been withdrawn by six witnesses but now with winning the appeal, Ruto's case is more or less on the brink of collapse.
The witnesses retracted the evidence for the reason that they had either lied or been coached to make up the evidence.
Ruto will now proceed to ask for his case to be kicked out for lack of evidence.
Bensouda had last year said that unless the retracted evidence was included, her case would be weak.
