Boy, 17, among three men charged for gang raping minor

Nyeri - Three men among them a 17-year-old boy have been arraigned in Nyeri court for allegedly gang raping a 13-year-old girl.
John Kahoro, John Waiti and the teenager had been charged that on April 10 and 11 this year at Giakanja village Nyeri County, they gang raped the minor.
They further faced an alternative charge of committing an indecent act with a minor.
They however pleaded not guilty on both counts before principal magistrate Desderious Orimba.
Lawyer George Gori, representing the accused applied for them to be released on reasonable bail and asked the court to take into consideration the fact that one of them was a minor.

Gori further asked to be supplied with witness statements, any documentary evidence and copies of the charge sheet that the prosecution intends to rely on during the case.
“I also wish to make an application to have the underage accused remanded at a juvenile home as he is a minor and the rest be released on bond and cash bail,” Gori submitted.
Orimba ordered for the age assessment of the teenage to be presented to court and that he is remanded at a juvenile home.
However, he denied the others cash bail but opted to free them on a bond of KES 500,000 each.
The case will be heard on May 2 with a mention of May 25, this year.
