Woman acquitted for murder of British geologist

Mombasa - A Mombasa high court has acquitted one of the eight suspects charged for the murder of a British geologist at Kambanga in Mwasui district within taita Taveta County.

In her ruling Justice Odero said that the 8 were jointly charged with the offence of murder under section 203,204 of the criminal procedure code.

Justice Odero said that she was satisfied that no primia facie case has been established against the 8th accused person Regea Omar.

“I here by acquit the 8th accused person under section 306criminal procedure code and she is to set at liberty otherwise lawfully held and the reasons will be detailed on the final judgment”, said Odero

However justice odero said that the remaining 7 accused person have a case to answer after a primia facie case was established against them.

She said the accused will have to give their defense to the charges in line with section 306 (1) of the criminal procedure code.

The court also directed the 5 suspects out on bond to continue reporting to the Taveta ocs in a fortnight basis this is after the assistant deputy public prosecutor Ondari informed the court that the 5th accused had differed with court order.

Its alleged that Mohammed Dadi Kakane, Alferd Njuruka Makoko, Samuel Mwachala, Jmaes Chacha Mwita Daniel Ndachi, Osman Hussein, Crispus Mukunguzi and Regea osman, on august 11 2009 at Kambanga in Mwasui district within taita Taveta County had murdered a British national Bridges Rodney.

The parties were alleged to have been involved in a disagreement over gemstone mine in Taita Taveta

The case will come fro defense hearing on February 21 and 22 2014.
