A 23-year-old woman has been sentenced to three years imprisonment by a Nyeri court for attempting to kill her estranged lover by stabbing him with a knife in a child maintenance row.
Agnes Wangari was found guilty of attacking Josephat Wahome with a knife and stabbing him behind his neck on March 19 2012, at Chania estate within Nyeri town.
Before Resident Magistrate Vincent Nyakundi, the complainant told the court that on the material day he had gone to a nearby shop to buy soap at around 11 am. He said his former girlfriend of four years with whom he had one child before their separation in 2011 confronted him from behind armed with a kitchen knife.
The 33-year-old mechanic added that Wangari stabbed him on the nape once after a bitter exchange, and then escaped immediately.
Wahome said the attack was sparked off by his failure to provide for their child’s upkeep, adding she had also taken him to children’s office where he explained he was not in a position to sustain him due to financial constraints.
He was assisted by members of public who offered him first aid to stop the bleeding and then rushed him to the Nyeri Provincial General Hospital for treatment.
In his ruling, the magistrate termed the incident as malicious and premeditated since she allegedly walked all the way from her residential home to where Wahome was residing armed with a knife.
He observed it was by sheer luck that the complainant survived the attack, adding were it not for the intervention of the members of public he could have died.
The magistrate said such offences have become rampant since women have taken upon themselves to attack men instead of seeking alternative mechanisms of resolving disputes.
The accused who had been out on a cash bail of KES 15 000, in mitigation prayed for forgiveness saying she was the sole provider for her child after the father abandoned his child maintenance role.
