Nairobi - Who is bigger? The Supreme Court or High Court? The Communications Authority CA has asked over the digital migration saga.
The CA lodged the application Wednesday in defence of a case in which activist Okiya Omtatah has taken them to the High Court seeking to have analogue transmission returned by the Authority.
He said in his application that the CA had done Kenyans an injustice by switching off analogue signal and in the process affecting TV viewership in the country.
But the CA has argued that the order to switch off analogue signal was arrived at the Supreme Court, which is the highest court in Kenya.
The case was thus postponed after CA raised objections on the jurisdiction of the High Court on a matter
that has already been determined by the Supreme Court.
CA is objecting the petition that seeks to
compel it to allow the three media houses, Nation Media Group, Standard Group and Royal Media Services to resume broadcasts on analogue as they
set up their digital broadcast infrastructure.
The media houses off air have TV stations namely KTN, NTV, Citizen TV and QTV, which have the highest viewership in the country.
The media houses are seeking a 90 day reprieve for analogue to continue so they can manage the transition smoothly.
The CA has argued that it offered the media houses alot of time to effect the switch and thus stuck by the initial date for the analogue switch-off, which was 31 December in Nairobi and February in other major towns.
