Nyeri - The election of Mary Wambui Munene as Othaya MP was null and void, court of appeal sitting in Nyeri has reiterated.
A three-judge-bench comprising of Justice Alnashir Visram, Lady Justice Martha Koome and Justice Otieno Odek maintained that the earlier ruling still stands and is in force.
During the case mentioned on Monday at Nyeri law courts, the bench said the ruling should not be doubted.
“We want to clearly and ambiguously clarify that the 4th March elections of the third respondent (Mary Wambui) was null and void,” said Justice Koome who read the ruling in the court.
The court said it was the duty of the electoral commission to take over the matter and ensure that the Speaker of the National Assembly was served with the right documents.
The mention of the case was set to clarify the typographical error following Wambui’s presence in the August house two weeks after her election was dismissed.
The parliamentary seat is set to be declared vacant.
