Vihiga MP, Chanzu retains seat

Vihiga - The high court in Kisumu has dismissed the petition challenging the election of Vihiga MP Yusuf Chanzu.
Chanzu will thus retain his seat as the area legislator after Justice Hillary Chimitei dismissed the election petition.
The petition had been submitted to the high court by Ernest Kavai (Kagesi) who came second in the last general election, garnering 7000 less votes than Chanzu.
The High Court had thrown out an application by Kagesi to have the votes recounted. He wanted the court to force IEBC to produce ballot boxes, manual register and all materials such as Forms 35 and 36.
He further argued that this would help establish the validity of votes cast, and security of the ballot boxes.
Justice Hillary Chemitei dismissed Kivai’s application, saying that the petitioner included in his application new allegations that were not in the affidavit he had earlier filed before the court.
Kagesi will consequently have to pay for the costs of the petition.
