Two charged with trying to escape from police cell

Kisumu - Two middle aged men have been sentenced to a total of 2 years in jail each for having staged a daring escape bid from Ahero police station in Nyando District.
Derrick Otieno Owiti, 22 and George Ouma Magak, 24 will each spend their time at Kodiaga GK Prison for having tried to escape from lawful custody contrary to section 123 as read with section 36 of the Penal Code.
Otieno and Magak were charged that on April 21st and 22nd, 2012 at Ahero police station cells, being in lawful custody staged a daring escape trying to break out of their cells with intent to escape.
Police at the Ahero Police Station found an underground hole in the cell occupied by the duo.
Nyando Senior Principal Magistrate, Dorah Chepkwony in her ruling stated that the prosecution case was strong and the evidence provided was candid.
"I believe the prosecution has proved the case beyond reasonable doubt and I, therefore, convict the accused person under section 215 of the Criminal Procedure Code", she declared.
The Magistrate pointed out that the second accused (Magak) was already serving another 4 years sentence, while his accomplice (Otieno) was a first offender.
Chepkwony noted the vice was prevalent at the Ahero Police Station and so stiffer penalties will be taken against offenders.
