Six County Executive Officers survive impeachment

Mombasa - Six Taita Taveta County Executive Officers survived an impeachment after the high court in Mombasa issued conservatory orders barring the County select committee from summoning and interviewing them.
Justice Mary Kasango issued the orders after the six; Stephen Masomo, Gifton MKaya, Flora Mtuweta, Joseph Mbogotho and Vincent Masawi moved to court on December 31 seeking orders restraining the respondents from summoning them.
Justice Kasongo said the applicants had the right to restrain them before the County assembly could take any further action against them.
A motion for the impeachment of the six was presented to the House by the assembly speaker following allegations that the County was not satisfied by the quality of service delivered by the six executive officers.
They six are also accused of abusing their offices and inability to discharge their mandates.

The applicant moved to court to stop the summons issued them by the Taita Taveta County select committee on December 29, 2014.
The six executive officers had argued in court that the respondents had not given them a fair hearing before resorting to impeach them.
They said that if the orders were not granted, they would suffer irreparably because they were not given a chance to defend themselves against the allegations level against them.
They argued that the responds failed to summon them to appear before the chambers of the house as required by the standing orders 64 (3) on the removal of a County Executive member.
The Executive Officers also said the impeachment motion against them was a witch-hunt against them with unknown motive.
Justice Kasango issued the granted the orders barring the respondents from summoning the applicants and directed the parties to fix an interparty hearing.
