Nairobi - TNA Chairman Johnson Sakaja is in office illegally, Danson Mungatana has said.
Mungatana made the accusation Tuesday as he represented his client Moses Kuria in-front of a disciplinary committee meeting which is deliberating on whether to punish Kuria over hate speech allegations.
He accused Sakaja of double standards by taking Kuria in-front of the committee while he himself is in breach of party rules.
" The Chairman is illegally holding both a public and party position. He does not have any moral authority to lecture anyone about party discipline,Mungatana said.
He was referring to the fact that Sakaja is currently the TNA chairman while still being a member of parliament.
Mungatana added that his client was being victimized by Sakaja
" The Chairman has said publicly several times that the party would use Kuria as a lesson which means there is no fairness in this process."
" How is that a fair process after the party has already condemned Kuria in this matter?" he posed.
Kuria is in trouble for calling on youths to take up arms against persons who are keen to see the downfall of the National Youth Service NYS.
He has since been taken to the High Court to have his case heard.
