Silas Otuke had filed the constitutional petition last year claiming that Hassan Joho had fake academic papers. He added on that Joho has never been a holder of a degree certificate to qualify to be the governor of any county in Kenya.
Recently,a panel of three judges at Mombasa high court rejected Otuke's petition.
Similarly, early this year, high court in Uganda had also quashed a similar petition against Joho, saying that forgery of the alleged academic papers was not proved to the required standards.
Kampala university head of legal department, John Kabagambe said that as a university, they are contented by both courts ruling. He said that from the beginning he expected the suit to be dismissed because it lacked merit.
He said,''I am going to file a bill of costs in the high court of Uganda against the petitioner for spoiling the image of our university. He has to pay for wasting our time.''
One of the students at the university,Daniel Lugala said,'' It is necessary to make those who make unfounded allegations against others to pay dearly for costs.
