Nairobi - The Independent Electoral and Boundaries Commision IEBC has said former CEO James Oswago can apply for the top job despite having an ongoing criminal case.
The IEBC said Friday that it will allow Oswago to apply for the job like any other Kenyan, despite suspending him because he had an ongoing criminal case.
" Mr Oswago can apply for the job, the IEBC confirmed Thursday.
The IEBC suspended Oswago, his deputy Wilson Shollei and two other top IEBC officials in November.
They then said that their suspension was in keeping with the law which requires that a public officer who is charged with corruption or economic crimes be suspended until proceedings against him/her are concluded.
The other two officials suspended by the IEBC were Finance and Procurement Director Edward Karisa and Procurement Manager Willy Kamanga.
The four have been charged with crimes including failure to comply with procurement laws contrary to the Anti-Corruption and Economic Crimes Act 2003 and abuse of office.
" The suspended officers are presumed innocent until proven guilty, it had then said.
Oswago has always maintained his innocence, claiming that he had nothing to do with the problems associated with the acquisition and use of the Biometric Voter Registration Kits which failed miserably in the March 2013 elections.
