Order on tinted windows for PSVs only: High Court
20 May 2014, 18:08
Nairobi - The High Court has ruled that the order on tinted windows applies only to public service vehicles PSVs.
Justice George Odunga clarified Tuesday that the order will and does not affect personal vehicles and ordered police not to arrest and impound vehicles fitted with such.
He was forced to clarify the order following a move by some Nairobi motorists to contest the ruling in court, saying innocent drivers were being harrased by police over an order that was illegal.
The move follows a ruling by the Independent Police Oversight Authority to state that the order on tinted windows is illegal and has no basis in law.
The Law society of Kenya had also said that the law was not right in its inception and asked motorists to move to court with their help in-case such an incident happened to them.
Inspector General of Police Davis Kimaiyo had said that the rule would help police catch-up with terrorists and thugs hiding behind the tints.
It followed a number of incidences where PSVs have bee targeted by terrorists, killing scores of Kenyans in the process.
