No bail for South Sudanese defiler

Nairobi - A South Sudanese man who defiled a 5 year old girl in Nairobi has been denied bail.
The High Court Friday declined to release the South Sudan national who is accused of defiling a five-year-old girl at the Nyayo Estate in Embakasi Nairobi.
In his ruling on Friday, Judge Luka Kimaru said that the man Makoy Deer has no permanent residence and is thus ineligible for bail since there is no place of reference for the court in-case he is needed.
Kimaru further noted that Kenya does not have an extradition treaty with South Sudan which would have given the court the option of sending him to face trial in South Sudan.
There was public outrage after Senior Principal Magistrate Timothy Okello granted Deer release on a KES 1 million bond on Tuesday, to huge protests from the state counsel. Magistrate Okello had said that Deer's eligibility for bail cannot be undermined because he is a foreigner.
The State though appealed the decision saying the 30 year old was a flight risk.
