Nairobi - Alfred Mutua remains the Machakos Governor after the Supreme Court threw out a petition seeking to have his election overhauled.
The Court ruled Wednesday that there was not enough evidence from the petitioner Wavinya Ndeti to have the case overhauled and thus ruled in Mutua's favour.
It said that Ndeti did not provide an grounds to show that the election had indeed been covered in misappropriations during the March 2013 General Elections.
With the ruling, it ordered the petitioner to pay for the costs of the petition.
The former Kathiani MP Ndeti had previously failed with her petitions at the High Court as well as Appeal court on technicalities since she had applied for the petition late.
Her stint at the Supreme Court was thus expected by many to fail.
The decision will please Mutua, who has had a number of attempts to oust him from office fail and will enable him complete his mandate for the County to the full 5 years.
