Nairobi - A matatu tout has been sentenced to death for killing a passenger over KES 100 fare.
The tout was sentenced to death Thursday by a Nairobi court for killing the passenger over a KES 100 fare he allegedly owed that was not paid.
Justice Nicholas Ombija Thursday sentenced David Gatembo to death for killing Antonius Odhiambo inside a public service vehicle on Mombasa Road on January 8, 2011.
" The prosecution has established beyond doubt that you used a screwdriver to stab the deceased after a quarrel over KES 100 change, leading to his death.
" The force you used shows you had an intention to kill. I sentence you to suffer death as a consequence of your action," ruled Justice Ombija.
The argument between the two arose after Odhiambo allegedly claimed that Gatembo had refused with his KES 100 as change for a trip from Mlolongo to Pipeline.
According to witnesses, Odhiambo handed Gatembo KES 200 for fare but instead of refunding KES 160, he only returned 60, which led to the argument and eventual fight.
Gatembo proceeded to stab Odhiambo to death using a screwdriver. He then claimed that Odhiambo was a carjacker but witnesses who were presented by the prosecution gave a different account of the story.
