Mary Wambui loses MP seat

Nyeri - The court of appeal in Nyeri on Thursday dismissed the election of Mary Wambui as Othaya MP.
The three judge bench comprising Alnasir Visram, Martha Koome and Otieno Odek said Wambui’s election was null and void.
The court said that according to evidence submitted to the High Court, the elections were not administered accurately in accordance with the law.
The court further set aside the judgment that was issued by Murang’a based judge, Jairus Ngaah on September 12, 2013 dismissing the poll petition that had been filed by Peter Gichuki King’ara.
The judge had said that King’ara did not furnish the court with sufficient evidence to justify his claims.
The court concurred with the petitioner's claims that the judge erred in law for failing to allow the application seeking scrutiny and recount of votes cast in the constituency in the March 4 polls.
In the ruling, the court has observed that the judge also erred by upholding Wambui’s election despite the numerous claims that were raised by the petitioner, which were all dismissed.
