Man to hang for robbery with violence

A Nanyuki court has sentenced a middle aged man to death after he was found guilty of robbery with violence.
Chief Magistrate Jesse Nyaga sentenced Martin Gitonga, a worker at Tima farm in Timau Township in Buuri district, the jail term after he found him guilty of the offence.
Gitonga had been charged for violently robbing Sospeter Kinuthia jointly with other people who were not before court.
The court heard that on January 30 this year, being armed with offensive weapons namely a metal bar and clubs, they robbed the complainant off a motorolla mobile phone, a pair of safari boots, a jacket, a national identity card and two pairs of trousers.
The charge further stated that they also stole from him an Equity bank ATM card and KES 6 500 cash, all valued at KES 12 200 and at or immediately before or after the time of such robbery used actual violence on the complainant.
Court prosecutor Chief Inspector Osman Mohammed told the court that on that material day, Kinuthia was walking home at 9PM when he was accosted by four people who hit him with a metal bar until he lost conscious.
Mohammed added that the complainant was rescued by a neighbor and they reported at Timau police station where investigations kicked off.
On February 2, at Tima farm where both the complainant and the accused persons are employed, the complainant saw Gitonga wearing a long pair of trousers similar to the one that he had been carrying when he was robbed.
He informed the guards and the accused person was arrested and taken to police station.
While convicting him, the Chief Magistrate noted that the accused person was guilty of the offence according to the information given by the witness.
In mitigation, the accused person told the court that on that particular day, he was watching television in his mother’s house together with his brother and sister.
His lawyer Kiprotich Kiget said they had nothing in mitigation.
Nyaga said that death is the only sentence provided by the law for the offense of robbery with violence.
