Nyeri - An elderly man who allegedly defiled his niece, 8, has been sentenced to life imprisonment by a Nyeri court.
John Maina Nderitu was found guilty of the offence by resident magistrate John Aringo.
He is said to have committed the indecent act on December 13, 2012 at Marwa village, Nyeri County.
Maina is also said to have issued death threats to the young girl after the ordeal, in a bid to silence her.
Maina had however denied the accusations claiming that he had not seen the girl on the said day as he had gone somewhere to eat meat.
On the contrary, the girl narrated to the court in a private session that she was going to tend to their goats which were tethered by the roadside near their home when she met the convict who is her distance uncle.
The accused invited her for a cup of tea in his house but when she refused he took her by the arm and dragged her to his single-roomed house.
He defiled the minor while covering her mouth with his hand.
When she got home, she told her grandmother what had happened and they reported the matter to the police leading to his arrest.
She further informed the court that the suspect is their immediate neighbour and that he used to escort her to school alongside her grandmother.
The convict lived alone as he had separated with his wife several years earlier before the incident.
While delivering the ruling, the magistrate observed, “In sum, the court is satisfied that the evidence adduced in support of the charge is clear and overwhelming to establish the offence on the principal charge. He is convicted of the offence", and handed him a life sentence.
