Man jailed for stealing from wife

A man who broke into his estranged wife’s house, stole and destroyed households accusing her of infidelity has been slapped four years jail term by a Nyeri court.
Appearing before Chief Magistrate Wilbroadah Juma, Peter Muchemi Muthoni admitted charges of house breaking, theft and malicious damage of property owned to Esther Wairimu Mwangi.
The prosecution told court that on April 4 2013, at Biriri location in Kieni Sub-County, the accused broke into the complainant’s house, stole and destroyed items including clothes all valued to be worth KES 21 130.
He is said to have committed the offence at midday while the complainant was away, taking some items to his separate home in the same area.
The court heard that the accused was arrested by police at Kiawara trading center carrying some of the items on his motorbike.
The accused told court the complainant was his former wife and whatever he destroyed was what he had bought with his own money.
However, the magistrate said he would have thought of other channels to sort out the issue instead of resorting to illegal means.
The magistrate further cracked the jail term into 18 months imprisonment for each of the offences of house breaking and theft adding one more year for malicious damage of property.
