Man given 20 years for raping a minor, infecting her with STI

Nyeri - A 40-year-old man who promised to give a girl KES 1,000 after a rape ordeal was on Friday sentenced to 20 years in prison by a Nyeri court.
John Muraya Kiragu was sent to jail by Nyeri resident magistrate, Joan Wabilyanga, after he was found guilty of defiling a 17-year-old girl.
Kiragu was charged that on January 30 at Ndugamano Village in Tetu constituency, he defiled the underage girl.
He also faced a second count of indecently assaulting the minor by touching her private parts. The girl testified that she was living with her cousin taking care of her children.
She told the court that on that day at around 2.00pm, Muraya went to their house asking about her cousin's whereabouts.
She said she was standing at the door when the accused violently took her arm and pulled her outside to the backyard.
He gagged her using his coat before he forcefully removed her pants and then pocketed them before the ordeal.
“After he was done, he promised to give me a thousand shillings and warned me not to tell anyone,” she said.
When her cousin came back home, she told her what had happened and then they reported the matter at Ndugamano police station and also took her to the hospital.
A doctor’s report indicated that the girl suffered multiple bruises and that her under pants were soiled.
“The girl was also infected with a Sexually Transmitted Disease (STD) during the act as the injuries revealed the offence had been committed recently,” the report said.
In defence, Muraya told the court that the allegations were not true claiming that they fabricated the charges to convict him because of a grudge he had with the minor’s cousin.
However, while issuing the ruling, the magistrate noted that the offence had been proved and the doctor’s evidence was clear.
“The blood and bruises report before the court show that the accused person raped the complainant and the offence was violent hence against the will of the complainant,” said the magistrate.
The court further observed that the girl was able to identify the accused using his popular name, 'Baba Kiragu'.
