Man gets one year imprisonment for stealing chicken

Nyeri - A man who stole a chicken worth KES 700 at Githaithi village, Nyeri County has been handed a one-year jail term by a Nyeri court.
Gideon Mwai Wangutu was slapped with the punishment by Resident Magistrate Catherine Mburu who said the accused was guilty as per the offence.
The charge sheet read that on March 13, this year at Githaithi village, Wangutu stole a chicken valued at KES 700 property belonging to Bernard Mwangi Thiong’o.
He also faced an alternative charge of handling stolen property.
To prove the case, the prosecution availed three witnesses while the accused called none.
In his evidence, the chicken owner said it was around 1.00am when he heard some noise coming from the chicken shed.
He went out and saw the accused holding the chicken and asked him how he gained entry into the homestead.
He said he entered through the gate.

The complainant said he called area Nyumba Kumi initiative chairman John Mwangi and a neighbour who apprehended the accused before escorting him to Muthinga police patrol base.
In defence, the accused said he was drunk during the incidence and could not understand what he was doing.
“The witnesses’ evidence confirms that the accused person stole the chicken and was indeed found with it,” the court observed while issuing the conviction.
The court further dismissed intoxication defence, stating that ‘defence of intoxication can not and does not stand’.
