Man arrested with bhang worth KES 20 gets 10 years

Nyeri - A middle-aged man was on Wednesday morning sentenced to ten years imprisonment for being in possession of two rolls of bhang worth KES 20.
Nyeri Resident Magistrate, John Aringo, handed Kelvin Musyoki Nzioka the sentence after finding him guilty of being in possession of the narcotics on March 20 at Majengo slums area in Nyeri town.
Musyoki had been charged alongside Kelvin Kawi Mwangi who has since absconded after he was released on a bond of KES 50 000 though a warrant of arrest has already been issued against him.
The court heard that two Administration Police officers were on a normal patrol within the area on the material day when they came across the accused persons smoking what they thought to be cigarettes.
The two scampered immediately after they noticed the officers but were arrested minutes later after a short chase.
Upon searching them, the officers recovered one full roll of bhang and another half-smoked butts from Musyoki, which were later verified to be cannabis by an analyst from the government Chemist.
The magistrate in his judgment observed that the evidence of the two police officers was consistent and credible, adding that the court was satisfied that the charges leveled against them had been proven beyond reasonable doubt.
Musyoki had been in remand since then after failing to raise the bond. Prosecutor Rhoda Kanyi told the court that they are still searching for the second accused.
