Man, 54, sentenced to 20 years for rape

Nyando law courts on Wednesday sentenced a 54 year old man to 20 years in jail for having defiled a girl aged 14 years.

Vitalis Migoya Onyango was charged before Nyando Senior Principal Magistrate Dorah Chepkwony with defilement contrary to Section 8(1)(3) of the Sexual Offences Act No. 3 of 2006.

It was stated that on March 2, 2013 at North East Kano location in Muhoroni District he defiled the 14-year-old girl.

Onyango faced a second count of indecent assault. The charge was that on the same day, date and venue, other than defilement he also committed an indecent act with the underage girl by touching her private parts.

Magistrate Chepkwony noted the offence as serious, adding that a stiffer sentence was appropriate despite the suspect’s advanced age.

"The age difference between him and the complainant (girl) is too big. The accused person has not given the court any good reason justifying his actions,” she emphasized.

Meanwhile, a woman who failed to prevent a child from early marriage at Kandaria in Nyakach district has been placed on probation for six months by Nyando law courts.

Rosa Akinyi appeared before Nyando Senior Principal Magistrate Dorah Chepkwony charged with failing to protect a child from harmful cultural rites contrary to section 14 as read with section 20 of the Children’s Act No. 8 of 2001.

The charge sheet stated that on diverse dates between March 26, 2013 and April 14, 2013 at Kandaria, Akinyi willfully failed to protect a child aged 14 years from a harmful cultural rite (early marriage) that negatively affected her physical and psychological development.
