LSK files petition to oust CJ Mutunga

Mombasa - LSK Mombasa branch have presented their petition to oust the Chief Justice Willy Mutunga before the Judicial Service Commission.
The branch chairman, Erick Nyongesa said the CJ lacks credibility to continue discharging the mandate of the Chief Justice.
Speaking after presenting the petition, Nyongesa said the Public Accounts office in its report had indicated that Mutunga was unfit to hold the office after it emerged that he had improperly allocated himself allowances that he was not entitled to.
“Mutanga has done very little to shape the Judiciary; its time he stepped aside. We cannot continue to suffer in his reign,” said Nyongesa.
He added that Mutunga had been engaging in cheap publicity instead of transforming the Judiciary.

He said the petition was anchored on incompetence, gross misconduct and misbehavior, serious violation of the constitution and incapability to perform the functions of his office.
Nyongesa also denied that he was fighting the LSK national chairman, Eric Mutua, whom he accused of covering up for the CJ.
He said Mutua had been acting as a gatekeeper while handling issues related to the removal of the CJ.
The Mombasa branch has accused of covering up for Mutua since he had failed to address issues raised by the members.
“We know that Mutunga is a uncle in-law to Mutua, which has prompted him to cover up for a relative,” said Nyongesa.
