LSK: JSC ruling within the law

Nairobi - Law Society of Kenya chairman Eric Mutua says the decision by the High Court to clip parliament's supervisory role over the Judiciary Service Commision is within the law.
There is a clash on the cards over the ruling by the High Court Wednesday which said that parliament has no right to supervise the JSC.
It also faulted a decision by president Uhuru Kenyatta to form a tribunal to probe malpractices by the commission.
The ruling Tuesday was made as MPs queried the decision by High Court Judge George Odunga to snap parliament's supervisory role.
Mutua though says that the ruling was constitutionally correct and that the JSC should remain as independent as possible to protect the judiciary.
" The ruling protects the sovereignty and independence of the JSC and that is constitutionally correct, he said.
" We must not forget that the role of the JSC is essentially to protect the judiciary and that is not a point of argument, he added.
MPs have called on Supreme Court interpretation on the matter, terming it a ridiculous move and one that cannot suffice.
