Kidero cautions Nairobi MCAs in impeachment, urges review

Nairobi - Nairobi governor Evans Kidero has asked for caution in deliberation of a case in which public works minister Evans Ondieki has been impeached.
The Nairobi County Assembly Speaker passed and approved a censure motion by Ngara Ward MCA Chege Mwaura on April 23 over the possible impeachment of Mr Ondieki.
The MCAs proceeded to impeach Ondieki in a special sitting Tuesday evening, the first move of its kind in the county.
Kidero, despite saying that the alleged charges should not be tolerated has insisted that the move to impeach Ondieki is rash and has called on thorough investigations be done on the matter.
He says that at the moment, he has not seen much to indicate grand misconduct on Ondieki's part and says that he hopes the MCAs decision will be reviewed.
In a letter to county speaker Alex Ole Magelo, Kidero has urged caution in the matter.
" The motion of impeachment contemplated by Article 75(2) of the Constitution and Section 40 of the County Government Act is irregular and there is no allegation that the Executive Committee Member has breached the values and principles of the Constitution and/or breached any written law which is mandatory before impeachment proceedings would commence, he said in the letter.
" There is need for strict adherence to the provisions of Article 47 of the Constitution as read with the preamble and Article 10 of the Constitution. It will be unfair and unjust to condemn a CECM on the basis of newspaper allegations which have not been substantiated.
" I urge the County Assembly to investigate further to ascertain the truthfulness and veracity or otherwise of the allegations, he added.
Kidero will decide the fate of the official once a hearing is set, to take in supposed complaints against Ondieki and then give him a chance to argue out his case.
