Former Naivasha Legislator John Mututho is currently facing a tough fine which he has to pay before expiry of the set deadline or face a severe penalty altogether.
In a case that was filed by Kilonzo and Company Advocates at the Milimani Law Courts involving an election petition dated back to 2008 polls, Mututho emerged a happy lot after winning the case against Jane Kihara, thanks to the mighty representation from Mutula Kilonzo Junior.
Unfortunately, he’s now having sleepless nights following the court order issued to him for having failed to honor the deal between him and the lawyer.
According to a testimony given by Mutula, Mututho had agreed to pay Mutula KES 13.5 million as legal fees for having rightfully represented him in the case.
Since then it’s confirmed that Mututho is yet to show any signs of fulfilling the agreement.
In a petition raised by Mutula on 19th February 2013, the Milimani Law Court ordered Mututho to now pay a fine of KES 6 000 000 as legal fess to the law firm or failure to that he risks having his personal property auctioned to meet the balance.
In the hearing which was conducted by High Court Deputy Registrar F. Wangila, a deadline of February 28th was issued to Mututho to consider meeting the fine.
In his defence, Mututho stated that he was willing to pay KES 1 000 000 and remit the remaining balance in installments of KES 100 000 per month.
However, the registrar directed that the case will be heard on the 28th of February to confirm compliance of the order.
