Nairoi - Moses Kajwang’ has been given the nod to vie for the Homa Bay senatorial seat after the Independent Electoral and Boundaries Commission (IEBC) dismissed a petition challenging his nomination.
The petitioner, Isaac Oluoch Aluochier wanted the Orange Democratic Movement (ODM) party ODM disqualified from participating in Homa Bay Senatorial by-election.
He argued that ODM committed an election offence when they nominated the late Senator Otieno Kajwang’ because he was then a serving state officer.
In a statement, IEBC said, the Dispute Resolution Committee (DRC) which summoned Kajwang’ on Monday dismissed with costs the complaint petition by Oluoch.

“The DRC noted in their ruling that the constitution (Paragraph 12 (2) of 6th Schedule) had a transitional provision that exempted those who served as ministers and therefore they could be nominated in the first General Election under the new constitution,” the IEBC said.
Kajwang' can now carry out his campaigns in Homa Bay as he prepares for the by election slated for 12 February to see if he will be elected to replace his late brother.
