Nairobi - The High Court has declared the tribunal named by president Uhuru Kenyatta to investigate the conduct of six Judicial Service Commision members null and void.
A five judge bench appointed by Chief Justice Willy Mutunga quashed the gazette notice on the presidential appointment of Justice Aaron Ringera, Jeniffer Shamallah, Ambrose Weda and Mutua Kilaka as members of the said tribunal and stopped them from assuming office.
The judges quashed the proceedings before the said tribunal seeking the removal of the Six JSC commissioners as well as the resolution of the National Assembly to seek President’s approval.
The bench further recommended the appointment of a committee to oversee all other committees’ in order to ensure better cordial relationship with all state organs and avoiding supremacy conflicts.
The move comes after the High Court in an earlier ruling said that the six JSC members were declared unlawfully reprimanded and demanded they resume their duties.
