Four years in jail for stealing beer

Four people have been sentenced to a total of 16 years in jail by Nyando law courts for stealing beer worth KES 80 000.
Erick Otieno Owiti, Nelson Mandela Oriero, Peter Abongo and George Ouma Magak were each sentenced to 4 years in jail by Nyando Senior Principal Magistrate Dorah Chepkwony.
The four were charged with burglary contrary to section 304(2) of the Penal Code.
It was alleged that on June 1, 2013 at Obiayo village in Ahero Township, the four, jointly with others not before court broke into the house of Josephine Wambani Githeka and stole 3 cartons of Windsok and 14 cartons of Redds all valued at KES 80 000.
The four were also faced with a second charge of handling stolen goods contrary to section 322(2) of the Penal Code. They were given 14 days to appeal against the sentence.
Meanwhile, a man who stole a mobile phone at Katito trading center in Nyakach District has been sentenced to 12 months jail term by Nyando law courts.
Daniel Ouma will cool his feet at Kodiaga GK Prison for a year for stealing, contrary to section 275 of the Penal Code.
The charge stated that on June 4, 2013 at Katito trading center in Nyakach, he stole a Nokia mobile phone valued at KES 2 500 property of Lindah Atieno Ojwach.
Ouma was brought before Nyando Senior Principal Magistrate Dorah Chepkwony who declared in her judgment that the offense was common and so deserves deterrent punishment.
“It deserves to be punished and I find his mitigation not plausible and therefore sentence him to 12 months imprisonment,” she ordered.
