Nyeri - A warrant of arrest has been issued against a Nyeri based lawyer suspected to be an imposter.
Nyeri Chief Magistrate John Oyiengo said Moses Kahiga Mungai alias Samuel should be arrested and arraigned on July 27, this year for failure to appear in court despite been summoned.
Kahiga is alleged to have been practicing as a lawyer and a state counsel since year 2011 without a Law Society of Kenya (LSK) certificate.
He was allegedly using an LSK admission number and certificate of a Meru based state counsel, Samuel Kahiga Mungai.
The court further directed that the latter record statement with police on why Kahiga was 'masquerading in his name’.
Kahiga's real identity was unmasked last week by his Nyeri colleagues led by lawyer Muthui Kimani who alleged that Kahiga did not graduate from Moi University School of law.
“Kahiga has been hired severally by office of Director of Public Prosecution to act on behalf of the government and is earning a salary from the government. He also participated in the recent vetting of Central Kenya police officers and earned KES 100 000,” lawyer Muthui told the court.
He added that Kahiga once worked in an advocate law firm in Nyeri town unsuspected.
As the revelations were being made, some of Kahiga’s clients were in the courtroom waiting for his representation.
However, according to the prosecution, Kahiga is out on a bond of KES 500 000 but his personal details and finger prints have been forwarded to national registration bureau, LSK and police officers for investigations.
“We are investigating whether he was impersonating or forged documents so as to be admitted as a lawyer. We also want to know about the two people sharing names,” said the prosecution.
While issuing the arrest warrant, the magistrate wondered how the suspect survived without being noticed.
“Lawyers must ensure their practicing certificates are up to date and mop out those without certificates,” stated the magistrate.
