Executives’ vetting in Nyeri was unfair

Nyeri - The vetting exercise of Nyeri County executive committee members was not fairly done, a rejected nominee Simon Wachira Kagiri told a High Court on Thursday.

Wachira moved to court complaining of contravention of his fundamental rights and freedom by the county committee of appointments which is chaired by the assembly speaker David Mwangi Mugo.

He told High Court Judge Justice Jorum Abuodha that the committee acted unconstitutionally by declaring him unsuitable to serve as an executive in the county government.

He said the vetting team rejected him on integrity grounds in regard to a criminal case which he was involved in but was later acquitted by court.

“It is unconstitutional that I was disqualified because I had been arraigned in court. Nobody gave evidence in the matter and I wonder how the committee came with that conclusion,” he said adding that no reasons were offered to his rejection.

According to Wachira, issue of the criminal charges of which he was acquitted were not supposed and should not be taken into account during the vetting.  

He stated that the vetting team which had six members rejected him on illegal, unreasonable, irrelevant and unconstitutional grounds since in their report they admitted that he had the right qualifications and good academic credentials.

The judge fixed September 10, 2013 to issue the ruling saying the matter should be determined fast so that the county government can discharge its obligations to the people.

Wachira, 57, had been proposed by Governor Nderitu Gachagua to head the docket of Tourism, Culture, Gender, Youth and Sports though his ambitions were cut short by the vetting committee which was not satisfied with his capacity to handle functions of the said department.
