Elderly man gets life sentence for defiling 9-year-old niece

Kwale - Kwale resident magistrate, Christine Njagi has sentenced an elderly man to life imprisonment for defiling a 9-year-old girl at Kibotoni village in Kwale County.

The court found Nyamawi Ndoro to have defiled his niece on July 30, 2013 when as she was collecting firewood near his house.

According to the complainant, when she went to borrow a rope to carry the firewood, Ndoro directed her to a nearby bush.

The uncle followed her and forcibly removed her pants before defiling her.

The girl's mother, Naomi Saidi noticed something was wrong as the minor went home crying with her private parts profusely bleeding.

According to prosecution witness, the mother reported the issue to the area chairman, Ndegwa Ndoro and referred them to Mwangulu police post before going to Msambweni Hospital for treatment.

The mother told the court how the suspect went to her home pleading for forgiveness but the family insisted on settling the matter before the court of law for their child to get justice.

The defendant said: “The incident took place on August 1, 2013. The girl came asking for a panga, which I gave to her and went back to sleep.”

He told the court that the only point of interaction with the girl was around 3pm when he gave her the panga and later went to herd his father’s cattle.

Magistrate Christine Njagi said that it was proven the case beyond reasonable doubt that Ndoro ohad committed the offence, and sentenced him to life imprisonment.

She also discharged the surety of KES 50 000 which Gladys Medza had presented before the court as security to the accused who was out on bond.
