Drug baron Feisal to spend new year's in jail
30 December 2014, 15:52
Nairobi - Drug baron Feisal Mohammed will spend new year's day in jail after being denied bail in his ongoing ivory trafficking case.
This follows an application for bail hearing failing to take place Tuesday after the presiding magistrate Richard Odonyo declined to have the case heard at his chamber and instead called on it to be taken back to the initial presiding magistrate.
He also directed that until that hearing materializes on January 9, 2014, the case be postponed till then and he be reprimanded in custody.
The ruling shocked Feisal and his team led by lawyer Cliff Ombeta, who argued that Feisal deserved bail as is provided in the constitution.
The prosecution though, led by chief prosecutor Alexander Muteti won the day after arguing that Feisal had disappeared before and was a threat to do the same if he was released.
He will be remanded at the Shimo La Tewa prison.
The Mombasa based businessman was charged alongside others over dealing in and having 314 pieces of ivory weighing almost three tonnes illegally.
Mohammed was arrested in Tanzania last week after disappearing for over a year. He was caught by a combined contingent of Kenya and Tanzania police as well as the International Police Agency Interpol.
