Couple denies conspiracy charges

A man and his wife were arraigned in a Nyeri court on Tuesday for threatening to kill another person.
Paul Ndururi and Fresher Wairimu Maina denied the charges that on October 25 at Nyeri lower Matatu stage within Nyeri town jointly with others not before the court they uttered threatening words to Samuel Kiamuri.
The prosecutor Eunice Maingi asked the court to detain the first accused, Ndururi, in Nyeri police station for two days so as to allow the police to complete their investigations, an application that was refuted by the defense counsel Njuguna Kimani.
Kimani told the court that the couple was arrested on October 26 and since then the police could have been through with the investigations, requesting the court to grant the two a reasonable cash bail.
Taking into account the counsel’s application, senior Principal Magistrate Shadrack Okato declined the prosecutor’s application saying that it is not fair for one person to be detained while the second accused be released on a cash bail.
Okato added that prosecution has not specifically indicated what more investigations were needed by the police.
The two were released on a KES 100 000 bond each with surety of the same amount or a KES 30 000 cash bail each.
The case hearing will be on December 5.
