Church elder sues his church, Pastor for ‘defamation’

Nakuru - A church elder has sued Presbyterian Foundation Church of East Africa (PCEA) and the Nakuru Church Reverend for defamation.
Joseph Kamira Wanjau on Wednesday moved to Nakuru High Court seeking general damages over an alleged defamatory letter sent to him by Nakuru PCEA Reverend LLyod Kabaiya.
Kamiru in his plaint stated the letter addressed to him by Kabaiya under instructions of PCEA Nakuru Church and its Foundation instructing him to surrender church property that he had been overseeing was malicious.
He claims that the words and phrases used in the letter to him on October 29, 2013 were also false and disparaged him as senior elder of the PCEA for many years.
He stated the letter read in part, "... due to the above the Presbyterian under Min 54/2013 resolved that you hand over the keys that you took, the documents concerning the above, the title deed and all financial returns that you have been overseeing at the Presbytery office."

Kamiru, who is also the owner of Cool Rivers Hotel in Nakuru, stated the Reverend further addressed the congregants of various churches within parish in three consecutive Sundays portraying him as scandalous.
"The first defendant in furtherance addressed congregants to the effect that the plaintiff was a dissolute and dishonest fraudulent character who had stolen and converted the church's Title Deed aforesaid to his own use as collateral to borrow money from various banks," he stated.
Through lawyer Karanja Mbugua, he told court as a result of the words used in the letter, his reputation in the whole church has been brought into public scandal, ridicule and contempt and has suffered general loss.
He is now claiming general and aggravated damages of unknown amount jointly from the Reverend and PCEA Foundation.
Lady Justice Hellen Omondi scheduled the case to be mentioned on December 10.
