Atwoli loses KES 500M case against Kambi

Nairobi - Central Organisation of Trade Unions COTU Secretary General Francis Atwoli has lost a KES 500 million defamation case against suspended Labour CS Kazungu Kambi.
COTU boss Atwoli has lost the defamation suit against Kambi Friday after a Nairobi Court granted Kambi leave from allegations of hate speech.
Justice Alfred Mabea ruled that there was no sufficient evidence to prove the defamation claim by Atwoli against the outspoken Kambi.
Atwoli had wanted the court to award him damages amounting to the KES 500 million after accusing Kambi of mentionuing him in relations to the murder of former Kabete MP George Muchai.
Justice Mabea however said that for one to be granted damages in a defamation suit, he or she must prove that the exact words complained of must exist in writing or in recording somewhere.
He added that even if he was to find Kambi guilty of defamation, the orders sought by Atwoli were overly general, vague and too ambiguous to vouch for.
Atwoli’s lawyer has indicated that he will appeal against the ruling.
Kambi had stated during Muchai's funeral that Atwoli and other COTU bosses had something to do with the murder of the former legislator who was murdered in cold blood together with his bodyguards along Kenyatta Avenue in February.
