American arrested with illegal arms out on KES 2M bond

Mombasa - A Mombasa law court on Thursday released an American national charged with illegal possession and importing of firearms after Judge Richard Odenyo ruled in his favour.
In his ruling Odenyo said, “The accused is a citizen of the United States of America and his application was within the constitution provision. I here by release him on a bond of KES 2 million and two Kenyan sureties of the same amount,” said Odenyo.
Earlier, the prosecutor, Simon Waithaka, had successfully filed an application denying the accused bail on grounds that he was a flight risk and might skip the courts proceedings since he is a foreigner.
“The accused has no permanent residence in Kenya and his motive of importing the guns to Kenya is not known and he failed to deposit his passport when asked by the court,” said Waithaka.
But the defense lawyer, Aaron wandera, had earlier appealed to the court to release Edward Roberts on bail on grounds that the charges against him were bailable.
Roberts was charged on December 23 with four counts of importing five guns and 243 rounds of ammunition in Changamwe. He also faces another charge of not having an import permit.
He had denied the charges and was remanded at Shimo la Tewa prison after his lawyer’s application to have him out on bail was dismissed by the court.
