A 30 year-old man was for the second time arraigned in a Nanyuki court yesterday charged with a similar count of improper use of a licensed telecommunication system.
This time, Richard Parsinei Liosoi pleaded not guilty before Senior Resident Magistrate Caroline Obara.
Liosoi had been charged that on 23rd February 2012 at 7:21 pm at unknown place in Laikipia county by means of licensed communication system namely Safaricom through telephone +254 717731500 sent an offensive text message “te wife will gte ur head in de black paper bag wl make sure umekufa I cannot give u bassary ur prostitute even ur bro. unashindana na ndovu kuhara court nitaenda na pesa zitafanya kazi nitoke u wil just all loosers idiot. Kwani umesahau babangu ni mganga hatari” to telephone number +254 710 366 672 belonging to Merrily Daniel Ole Kanjori with an intention of annoying him.
Obara released him on a bond of ksh 50,000 but the accused pleaded for an alternative cash bail.
She imposed an alternative cash bail of Ksh 30,000 on him and fixed the hearing on 18th June next month.
Barely two weeks ago on 20th April last month, the accused had been fined KES 10,000 in default three months imprisonment by a Nanyuki court charged with a similar offence.
Liosoi had been charged that on 16th February 2012, at the same place, he had sent an offensive text message “Bibi yako ni Malaya n I cannot 4 her sch fee na ukijaribu kustaki I’ll u dat ur going 2 take Action” to the same Merrily Daniel Ole Kanjori with an intention of annoying him.
Liosoi pleaded guilty before Chief Magistrate Jessie Nyaga and mitigated that he was drunk when writing the text message.
He paid the fine and was set free by the court.
